The PDP in Ngor, Ward 1 in Andoni Local Government Area, had suspended Abiante, the lawmaker, accusing him of creating faction in the party.
The resolution suspending Abiante was signed by the PDP Caretaker Committee Ward Chairman in Andoni LGA, Dike Bara and CTC Ward Secretary, Dokubo Jackson, and 12 other executive members.
But the court on Friday made orders of interim injunction voiding his suspension following a suit he filed challenging the punitive measure.
Abiante listed Bara, Jackson, Smith Green, Nte Obieaia as first set of defendants and Owoukagakemi Lawrence as well as Stephen Jumbo as the second set of the defendants.
Making the orders, the Presiding Judge, Justice G.O. Ollor, restrained the defendants and their agents from tampering with the membership of Abiante or doing anything that will deprive him of his rights as a full member of PDP Ward 1, Ngor Town.
The judge also restrained the defendants and their agents from preventing Abiante from participating in all the activities of the PDP in all the wards, local government, federal Constituency, Senatorial District and the state.
The judge further prevented the defendants and their agents from forwarding the letter of the suspension to any of the executive bodies or organs of the PDP at the zonal, state and.national level aimed at affirming the suspension.
The court also restrained the defendants and their agents from doing anything whatsoever either by themselves or through any organ of the party, however styled, from tampering with his seat as a member of the National Assembly.
The court insisted that the parties must maintain the status quo antebellum pending the determination of the motion on notice.
