The decision was communicated in a letter dated May 22, 2024, addressed to Matthew Burkaa, SAN, FCIArb (UK), counsel for the APC. The letter, signed by Joshua Ibrahim Aji, Esq., Special Assistant to the Honourable Chief Judge, stated that the transfer was carried out after considering the reply from Chief Chris Uche, SAN, counsel for the plaintiff, to the 1st defendant’s application.
The case, initially slated for mention before Hon. Justice Inyang Ekwo in Abuja on May 29, will now be heard at the Federal High Court in Akure.
This transfer aligns with the extant practice direction issued by the Honourable Chief Judge, which stipulates that all pre-election matters should be heard and determined in the judicial division where the election took place.
Senator Jimoh Ibrahim had filed a case against the APC and two others, challenging the conduct of the Ondo State Governorship Primary Election.
The transfer of the case to the Akure Division is expected to facilitate a more efficient and localized resolution of the matter, as it falls under the jurisdiction where the primary election was held.
The Federal High Court’s decision to transfer the case demonstrates its commitment to ensuring that pre-election matters are handled in accordance with the established practice direction and in the most appropriate judicial division. This move is likely to expedite the legal process and provide a more convenient venue for all parties involved in the case.
