During Monday’s session, the Independent National Electoral Commission (INEC), the APC, and Governor Ododo urged the court to dismiss Ajaka’s petition, citing its incompetence and lack of merit. This was presented by their legal representatives, Kanu Agabi, Joseph Daudu, and Emmanuel Ukala, while adopting their final written addresses.
However, Ajaka’s counsel, Pius Akubo, urged the tribunal to disregard Ododo’s submissions and uphold theirs.
Following the arguments from all parties, the tribunal, led by Justice Ado Birnin-Kudu, reserved judgment, with the date to be communicated to both parties.
Recall that INEC had declared Ododo the winner of the November 11, 2023, Kogi State Governorship Election. Ododo secured 446,237 votes, defeating his closest rival, Ajaka of the SDP, who scored 259,052 votes. Dino Melaye of the Peoples Democratic Party (PDP) polled 46,362 votes.
